With four days until New York plans to start charging a $9 congestion pricing fee to enter Lower Manhattan, New Jersey’s attorneys are going back to court to slam the brakes on starting the controversial program.

The MTA is reminding drivers to update their E-ZPass accounts before congestion pricing starts this weekend. The toll goes into effect on Jan. 5. Drivers entering Manhattan at and below 60th Street will pay a $9 toll once a day between the hours of 5 a.

Gov. Phil Murphy’s attorney claims a judge’s ruling this week effectively rescinded key federal approvals for the tolling program.

The legal battle over New York’s congestion pricing is not over yet, thanks to neighboring New Jersey. Federal Judge Leo Gordon has set a Friday 3 p.m. hearing in Newark — just 33 hours before congestion pricing is presently scheduled to begin — to consider a Temporary Restraining Order filed by the state of New Jersey.
